It could, however, happen soon. The speculation followed a tweet by Reorg reporter Harvard Zhang, claiming that Juul was [preparing to file chapter 11 bankruptcy." The bankruptcy news isn`t really new But the Wall Street Journal and Bloomberg had already reported-as early as June 24-that Juul has been working with advisers to address its financial challenges, and has considered chapter 11 bankruptcy as one of several options. In other words, Juul has been [preparing" for a potential bankruptcy filing for at least three months. Chapter 11 allows a company to continue operating while it works with a court and its creditors to reorganize its finances. It doesn`t necessarily signal the death of the company. The Journal reported Tuesday evening that Juul has received inquiries from lenders and [will soon formally request debtor-in-possession financing options," which (if pursued) would allow the company to maintain operations during the bankruptcy process. Bloomberg News reported essentially the same thing. [We will continue the preparation process for both a restructuring and other strategic options as we determine what path is best for our company," said a Juul spokesman, indicating that the company hasn`t yet settled on chapter 11 (restructuring). Juul faces huge market and financial challenges Juul has lost its position as the top product in the convenience store/gas station segment of the vaping market, facing growing competition from Vuse and hundreds of disposable vape products in recent years that has reduced its market share by more than half. Altria Group last week ended its non-compete agreement with Juul, meaning Juul could soon face additional competition from products sold by its part-owner Altria. In Denmark, Estonia, Finland, Hungary and Lithuania, flavored vape restrictions are already in place, and Ukraine's flavor ban will take effect in July 2023. No European country has an outright ban on all vape products. The new list of allowed ingredients = a stealth ban on all vapes The consultation is a chance to specifically comment on a new amendment to the country`s Tobacco and Smoking Products Order that goes a step further than the previously announced flavor restrictions. The Dutch National Institute for Public Health and Environment (RIVM) and Ministry of Health have proposed a list of just 16 ingredients that would be allowed in legal tobacco-flavored e-liquids. But manufacturers say the limited list of allowed ingredients would make developing new flavors impossible-including tobacco flavors. According to Dutch vape advocates, the ingredient restrictions will essentially put all e-liquid manufacturers in the Netherlands out of business, since they would have to scrap their existing products and would be unable to reformulate their tobacco flavors using the new list of allowed flavorings. How to respond to the Dutch consultation Although the law will only directly affect the Netherlands, any government policy on a subject as controversial as vaping can have influence beyond the borders of the lawmaking country. That`s especially true in the European Union, where member countries routinely collaborate on health- and tobacco-related issues. Blokhuis justified the proposed flavor ban using a government-commissioned study by the Trimbos Institute that leveraged cherry-picked science to back its claim that flavored vape products attract adolescent users. The study also claimed that [there is increasing evidence that the e-cigarette is a stepping stone to tobacco cigarettes," despite the lack of any real-world evidence of a [gateway effect." The government launched a public consultation in December 2020, which received a record number of comments-almost all opposing the law-and vaping advocates also delivered to the government a petition signed by 19,000 consumers opposing the restrictions. In May 2021, the outgoing Dutch cabinet (Council of Ministers) approved the flavor ban, despite massive opposition from vapers and the independent vaping industry , which was led by Dutch consumer vaping organization Acvoda and industry association Esigbond. The law was scheduled to take effect July 1, 2022. Then in March 2022, Esigbond alerted the government that some of the original list of RIVM-approved ingredients were known carcinogens, so the Dutch cabinet postponed implementaion of the law until 2023 while it revised the list. Now the Dutch government will have to ignore a second round of opposition from vapers in the Netherlands and across Europe in order to implement its draconian response to teenage experimentation.

Police officers in Thailand are under investigation for soliciting bribes from three men caught entering the country carrying vaping devices and e-liquid. The events happened in Songkhla province, which borders Malaysia. Thailand has one of the world`s strictest vape bans. Sales and importation of e-cigarettes and other vaping products is illegal in Thailand, and vapers are sometimes even prosecuted for possession of the devices. But despite the ban and sometimes harsh enforcement, the country maintains a thriving black market in vaping products. There has been some recent debate about loosening vape laws in Thailand, with one cabinet minister strongly advocating for a regulated market. He has faced stiff opposition, however, with the country`s public health establishment squarely lined up against liberalization. Police negotiated the bribe amounts The three men were caught at a police checkpoint in the Hat Yai district of Songkhla province, apparently bringing vaping products into the country from Malaysia. According to The Thaiger, the men were told by local police officers that the fine for possession of e-cigarettes would be 50,000 baht (about $1,365 U.S.) each, but that they wouldn`t be charged if they each paid a 10,000 baht bribe (about $273). When they refused to pay the bribe, the police lowered the amount to 5,000 baht, and then eventually reduced it again to a total of 10,000 baht for all three men. The men agreed to this amount and were released. One of the bribery victims, Pachara Sirithorn, decided to warn others by telling his story on Facebook. The post got enough attention that police leaders were forced to take action, and the Hat Yai Police superintendent Akkarawut Thaneerat announced an investigation and the temporary suspension of three officers suspected of soliciting bribes. Thailand`s history of harsh enforcement and corruption There is a history of police corruption and overzealous enforcement of Thailand`s vape laws, including raids and arrests of sellers, tourists charged with [importation" for bringing their own vaping products into the country, and other instances of alleged bribery. Thai police actions have been so extreme regarding vaping that an official British government travel website in 2017 warned UK tourist against taking vapes to Thailand. Police corruption in Thailand isn`t restricted to soliciting bribes from vapers, of course. A quick Google search brings up many recent examples. In June, a Bangkok Metropolitan Police officer was convicted of soliciting 65 bribes from a massage parlor and sentenced to 50 years in prison. Earlier this year, six Nakhon Phanom provincial police were transferred pending an investigation into bribery by drug dealers. And last year a man suspected of dealing meth was suffocated to death by police during what was apparently a violent shakedown. The prime suspect in the death was the local police chief. Thailand`s tobacco industry is both owned and regulated by the Tobacoo Authority of Thailand , a state-run monopoly similar to China`s. The Tobacco Authority is the only state-sanctioned producer of cigarettes in Thailand.
